The underwater-bookshop (www.underwater-bookshop.com) and The underwater-watchshop (www.underwater-watchshop.com) (“we”, “our”, “us”) are trading names of Atlantis Mall Limited, a UK business. These terms and conditions (“terms”) are the only terms on which we supply goods and are set out below. Separate terms apply for the supply of trade services. Please read these terms carefully. Please also read our Privacy statement regarding personal information provided by you. We recommend that you print the terms out for reference in the future.

2. Use of this site .

By accessing and using any part of this web site, you agree to be legally bound by these terms which take effect immediately on your first use of the site. If you do not agree to be legally bound by the following terms, you may not use this site or acce

3. UK customer’s statutory rights are not affected by any of these terms.
4. We reserve the right to refuse the supply of goods and services at our absolute discretion.

5. Offer and acceptance

A binding contract is formed between you and us when you receive confirmation from us by e-mail, telephone or other agreed means that your order has been accepted.

6. Returns & Refunds (European Union consumers only)

6.a If you are not completely happy with the goods –unwanted goods
We want you to be totally satisfied with every purchase you make from us. We aim to offer you value and quality. To cancel you can telephone, e-mail, fax, or write to us via the details below within 7 working days of delivery, quoting your order number.

For cancelled items we will offer you a full refund or exchange it they are returned to us within 7 days of your cancelling the agreement. Items returned must not have been used, should be returned in their original packaging and you must take reasonable care of them. You will pay the cost of returning the goods. At your request we may collect the goods for you, however there will be a charge for this service. The address for returned items is as listed in Section 1 Business Contact Details.

Items can be returned to us provided:

  • Books are in an unused condition (complete with dust jacket where applicable).
  • Any other item is complete, in its original condition and packaging.
  • A copy of the invoice note or proof of purchase is included.

    Note: When returning goods we recommend that you use a recorded delivery or traceable service, as we are unable to accept responsibility for returns that fail to arrive to arrive at our premises.

    6.b You lose the right to cancel if:

  • you have had the goods personalised (for example an authors dedication).
  • you have opened sealed audio or video recordings, or computer software.
  • you have opened or tampered with cases or backs of watches.

    6.c If the goods are damaged or faulty

    Please examine the goods on delivery in case they are damaged, missing, wrongly supplied or faulty. If you inform us within 7 days of receipt of delivery that the goods are delivered damaged or faulty we will refund return postage and replacement at our expense. You may inform us by any of the Business Contact Details given in Section 1. Please ensure that the original packaging is kept for examination.

7. Complaints Procedure

We endeavour to respond to all complaints within 3 working days. We will acknowledge receipt of any complaint and give an indication of the timescale expected to resolve the complaint. We will keep you informed regarding the progress of the complaint.

8. Prices, statements, descriptions

8.a. All prices, statements, descriptions on our site are invitations to treat
The price you pay is the price displayed on this website at the time we receive your order apart from the following exception. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

8.b. Website pricing and indication of price
All prices displayed on the website are given in Pounds Sterling and are inclusive of any VAT.

Note: Costs such as Carriage etc are chargeable in addition to the item price displayed and costs are clearly displayed on the site. Orders may be changed or cancelled before final submission.

Customers outside the EU should call to confirm the cost of goods excluding VAT and the appropriate shipping costs.

8.c. Currency
All prices will be charged in Pounds Sterling (£) Customer outside the UK should be aware that local currency rates may vary.Customers outside the UK should check with their bank or credit/debit card company for the exact exchange rate and any additional costs that may be incurred following a transaction in Pounds Sterling.

9. Payment Options

9.a On-line and telephone payment by all major credit and debit cards
We accept on-line and telephone payment with the following cards:

• Mastercard
• Visa
• Delta
• Switch Maestro
• Solo
• Eurocard
• American Express

We also accept all credit and debit cards carrying the Mastercard or Visa logos. We reserve the right to decline any credit or debit card including major ones.

Payment by card may be made by entering the card details on the secure payment screen or you may telephone our customer sales line on +44 (0)1785 761966

We are unable to despatch goods until payment had been cleared or authorised. Payment will be processed when the goods are ready for despatch. All back-orders will only be charged when ready for despatch. Where an item has to be specially ordered for the customer, payment will be processed at the time of order.

Please be aware that all credit and debit card transactions will appear on your monthly statement as Atlantis Mall Limited.

9.b. Payment by cheque or postal order
If you wish to pay by cheque or Postal Order simply select payment by personal cheque when you reach the payment screen. When you receive confirmation of the order from us send a cheque or Postal Order made payable to Atlantis Mall Limited. Please write your order number and name/address on the reverse of the cheque. Your order will be despatched once the cheque has cleared.

9.c Shipment outside EU

We regret that due to the high incidence of international fraud on both credit cards and cheques we are only able to accept orders from outside the EU where payment is made of cleared funds direct to our bank account. IF you wish to pay by this method, please contact us to make arrangements.

10. Goods are subject to availability

Books and all other products offered for sale have a limited production span and may either be re-printing or out-of-print (books) or out of production. Whilst we endeavour to provide the best information on product and stock availability, occasionally goods become unexpectedly unavailable. In the event that we are unable to supply the goods or services, we will inform you as soon as possible (normally the same working day). A full refund will be given where you have already paid for the goods or services.

11. Delivery times, options, deadlines and guarantees

11.a Delivery Options
The website lists all delivery options available. Pricing comparisons can be made via the website on the order pages. Carriage options are only listed within the order pages. High value items may only be available when delivered via a signed for service.

11.b. Guaranteed Services
For guaranteed services we endeavour to despatch the same day if the order is placed on or before 2pm GMT. This service is subject to availability as Section 10. Orders placed on Saturday or Sunday will be despatched on Monday as no guaranteed services operate over the weekend. Similarly orders placed during a Bank Holiday will be despatched on the next working day. This guaranteed service is subject to payment clearance.

Note: Guaranteed Services refers to Parcel Force 24, Royal Mail Special Delivery and Parcel Force Euro 48, Parcel Force Ireland 48 & Parcel Force Channel Islands 48.

If a guaranteed service is selected and the goods are not received within the published terms of the service, please contact us so that we may investigate. We accept no liability for failure of a carrier to deliver within the terms specified, however, where a guaranteed service provides for a payment as reparation, we will arrange to claim this and remit such amount to you.

11.c. Delivery within 28 working days from receipt of your order

We endeavour to ship all orders within 2 working days of receipt of your order and payment clearance on a 2-3 day delivery service. However, while we strive to meet this standard we reserve the right to ship within 28 days from receipt of order and payment confirmation. If an item is temporarily out of stock and despatch is anticipated to be greater than 28 days, we will contact you to arrange a new delivery date. At this time you will be given the opportunity to cancel the order.

Note: Non-guaranteed services include all carriage options excluding those listed as guaranteed services (see above).

12. On-line security

All reasonable precautions will be taken to ensure the details of your order and payment remain secure. However, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you. Please view our privacy statement for a full statement of our policy on confidentiality.

Our site uses a fully accredited secure environment to protect your credit card information, click here for verification. Personal details are also kept in a secure area. If you have any questions regarding on-line security please e-mail us.

We appreciate that despite our high standard security safeguards, some customers may still be reluctant to release card details on-line, for these customers we offer a telephone order service, simply call +44 (0)1785 761966.

13. Guarantee

All our products are guaranteed against manufacturing defects for a minimum of 12 months.

14. Trademarks

The names ‘underwater bookshop’, ‘underwater watchshop’, ‘ukdiving’, ‘dive-international’ and ‘Atlantis-mall’ and their various devices and logos are all trademarks of Atlantis Mall Limited. Wherever other trademarks are used these are the property of their respective owners. All trademarks are recognised. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of Atlantis Mall Limited, or any other.

15. Copyright

All information and data held on this site is the copyright of Atlantis Mall Limited. All graphics, design and software are the property of Atlantis Mall Limited and are copyright.

16. Reviews

Where you submit any contribution to any of our web sites (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant Atlantis Mall Limited a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the Atlantis Mall Limited's Privacy Policy. If you do not want to grant to Atlantis Mall Limited the rights set out above, please do not submit your contribution.

Atlantis Mall Limited reserves the absolute right to delete any contribution at any time

17. General

17.a These terms shall be governed by and interpreted in accordance with the laws of England and Wales

17.b Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England and Wales under English Law.

17.c Those who access the site from other locations or purchase good for delivery outside the UK are responsible for compliance with their local laws and taxes as applicable.

17.d If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

17.e. Atlantis Mall Limited reserves the right to change or amend these terms at any time by publishing revised terms on the web site.
